The arbitration will take place in Los Angeles County, California, unless the parties agree otherwise. Judgment upon the arbitrator’s award may be entered in any court having jurisdiction. This section survives termination of your use of the Site.

HOMEPRO HUGH AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEPRO HUGH AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE OR THESE TERMS, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.

11. Termination; Access Restriction

HomePro Hugh reserves the right, in its sole discretion, to suspend or terminate your access to the Site (or any part thereof) at any time, with or without notice, and for any reason. We may also restrict or block your access if you violate these Terms or engage in activities that we, in our sole discretion, consider harmful to the Site or other users.

These Terms are governed by and construed under the laws of the State of California without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any disputes not subject to arbitration.

12. No Agency; Relationship

Nothing in this Agreement creates a joint venture, partnership, employment, or agency relationship between you and HomePro Hugh. HomePro Hugh’s performance of these Terms is subject to existing laws and legal processes, and nothing in this Agreement limits HomePro Hugh’s right to comply with governmental or law enforcement requests.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed modified or replaced to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms will remain in full force and effect.

14. Entire Agreement

These Terms (together with any documents expressly incorporated by reference) constitute the entire agreement between you and HomePro Hugh regarding the Site and supersede all prior or contemporaneous oral or written communications, proposals, and representations regarding the Site.

15. Changes to Terms

HomePro Hugh reserves the right to modify these Terms at any time, in its sole discretion. If we make material changes, we will update the “Last updated” date at the top of these Terms and post a notice on the Site. Your continued use of the Site after such modifications signifies your acceptance of the updated Terms.
